1. Acceptance of terms

Accessing and using the website https://10tenrental.com (hereinafter, "the Site") implies express and unreserved acceptance of these Terms and Conditions by the user. If you disagree with any of the conditions described here, please do not use the Site.

2. Identification of the owner

The Site is operated by 10 Ten Rental SpA, RUT 00.000.000-0, with domicile at Av. Providencia 1650, of. 401, Providencia, Santiago, Chile.

3. Purpose and services

10 Ten Rental provides equipment rental services —including, without limitation, all-terrain cranes, forklifts, compressors, generators and light towers— to mining companies, contractors and other industrial actors within Chilean territory.

The Site is intended for informational and commercial purposes: to learn about our services and request quotes. No published information constitutes a binding offer unless it is expressed through a formal quote signed by our commercial team.

4. Quotes

Quotes will be delivered in writing via email or another formal means.
The validity period of each quote will be indicated in the corresponding document; otherwise, it will be considered valid for 15 calendar days.
Rates published or referenced on the Site are merely indicative and may vary depending on technical conditions, site location, term, availability and other factors.
Prices do not include VAT unless expressly stated.

5. Hiring and reservations

The actual hiring of a rental service is formalized through a purchase order, written contract or the client's express acceptance of the quote. Equipment reservation is subject to availability at the time of confirmation.

6. Client obligations

Provide accurate information when requesting the quote and contracting the service.
Use the equipment in accordance with its technical specifications and operating manuals.
Comply with the current mining and labor safety regulations (including those issued by SERNAGEOMIN and Law No. 16,744).
Ensure that only trained and authorized personnel operate the equipment.
Pay the agreed rates on time.
Report any incident, failure or anomaly within 24 hours.

7. Liability

10 Ten Rental is responsible for delivering equipment in optimal operating conditions and in accordance with the quote. The client is responsible for the correct use of the equipment during the rental period, as well as for any damage caused by misuse, negligence or non-compliance with operating standards.

10 Ten Rental will not be liable for:

Loss of profits, indirect or consequential damages to the client or third parties.
Delays caused by acts of God, force majeure, extreme weather conditions, road blocks, stoppage of activities at the site or other causes not attributable to the company.
Use of the equipment by unauthorized personnel or under conditions other than those specified.

8. Payments and invoicing

Payment terms will be agreed in writing in each quote or contract. Payment default will entitle 10 Ten Rental to suspend the service, withdraw the equipment and charge the maximum legal interest rates in effect, without prejudice to any other applicable legal actions.

9. Cancellations

Cancellations must be notified in writing. Depending on the timing of the cancellation and the equipment mobilization status, they may incur transport costs, administrative charges or other previously communicated fees.

10. Intellectual property

All Site content —including texts, images, logos, graphics, designs, software, trademarks and other elements— is the property of 10 Ten Rental or its licensors and is protected by Chilean and international intellectual property law. Its reproduction, distribution, public communication or any other use without express written authorization is prohibited.

11. Links to third-party sites

The Site may contain links to third-party websites. 10 Ten Rental does not control the content or policies of those sites and assumes no responsibility for them.

12. Modifications

10 Ten Rental reserves the right to modify these Terms at any time. Modifications will take effect upon publication on the Site. We recommend reviewing this document periodically.

13. Applicable law and jurisdiction

These Terms are governed by the laws of the Republic of Chile. Any dispute arising from their interpretation or execution will be submitted to the jurisdiction of the Ordinary Courts of Justice located in the city of Santiago, unless otherwise expressly agreed.

14. Personal data protection

The processing of personal data collected through the Site is governed by our Privacy Policy, which is an integral part of these Terms.
